3. Orders, Refunds, Shipping, Exchanges and Customization Policy

At Wear Hour Time, we specialize in combining individual wearables and timepieces to create unique, handcrafted products. Carefully review your order before confirming, as our products are made to order. Please note the following:

Order Process:

• Materials (a wearable item and a timepiece) are ordered upon receiving customer payment.

• The creation process begins once the customer’s order is placed, and payment is confirmed.

Refund Policy:

• Once payment is confirmed, the creation process for your order begins. Due to the custom-made nature of our products, refunds cannot be issued after the order process has been initiated.

• If the product is defective or damaged upon arrival, please contact us within 7 days of receiving your order. We will work with you to resolve the issue.

Exchange Policy:

• Since each material (wearable item and timepiece) is altered into one product, exchanges are not typically accepted. However, if there is a manufacturing defect or an error with your order, please reach out to us as soon as possible so we can assist you.

• We reserve the right to accept or decline exchange requests.

Shipping Policy:

• Domestic Shipping: We offer free shipping as a courtesy to our customers for all orders within the United States.

• International Shipping: For international orders, customers are responsible for any applicable import duties, taxes, or customs fees. These charges are not included in the purchase price and must be handled directly by the customer.

• Return Shipping for Exchanges: If your exchange request is accepted by Wear Hour Time, we will provide you with the necessary instructions, including a return address, QR code, or other shipping method to facilitate the return. Customers must follow the provided instructions to ensure proper handling of the return.

Customer Responsibility:

• Wear Hour Time is not responsible for returns sent without prior approval or identification, including packages shipped to incorrect addresses or without proper documentation. Any negligence in following our return procedures will absolve Wear Hour Time of liability.

• Customers are required to package return items securely and provide proof of shipping if requested.

Third-Party Items:

• The wearable items and timepieces we customize are sourced from other companies.

• Wear Hour Time LLC does not own or manufacture these individual components but provides tailoring and customization services to combine them into a unique product.

4. Sales Tax

Sales tax will be applied to all orders shipped within Texas, in accordance with state law. The applicable sales tax rate will be calculated and added to your order during checkout, based on the shipping address provided.

At this time, Wear Hour Time does not charge sales tax for orders shipped outside of Texas. Customers located outside of Texas are responsible for any sales tax, use tax, or other similar tax obligations that may apply in their jurisdiction.

5. Account Security

If you create an account with Wear Hour Time, you are responsible for maintaining the confidentiality of your account login details (username and password) and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other security breach. Wear Hour Time is not responsible for any loss or damage resulting from your failure to protect your account information.

• Customers are responsible for ensuring that any wearable item or timepiece submitted for customization is authentic and legally owned. Wear Hour Time does not accept or work on counterfeit, replica, or illegally obtained items. If an item is found to be counterfeit or in violation of any intellectual property laws, Wear Hour Time reserves the right to refuse service and report the issue to the appropriate authorities.

Intellectual Property of Wear Hour Time:

• All content on our Website, including text, images, and designs, is owned by Wear Hour Time LLC or its licensors and is protected by intellectual property laws. Unauthorized reproduction or use of this content is prohibited.

14. Terms of Service Disclaimers

Customization Services Disclaimer:

• Wear Hour Time LLC provides tailoring and customization services by combining wearable items and timepieces into a unified product. As such, we are not the original manufacturers of the items.

• All warranties, defects, or claims associated with the individual components should be directed to the original manufacturers unless the defect is a result of the customization process carried out by Wear Hour Time LLC.

Limitations on Liability for Third-Party Items:

• Wear Hour Time LLC is not liable for defects, damages, or issues related to the original materials used in our products that were manufactured by third-party companies.

• Any modifications, alterations, or adjustments made during the customization process are done at the customer's request and as part of Wear Hour Time’s service offering.

• To the fullest extent permitted by law, Wear Hour Time LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or data, arising from your use or inability to use the Website, products, or services, even if Wear Hour Time has been advised of the possibility of such damages. 16. Customer-Provided Items Policy

• Customer Assumption of Risk

  • Customers who provide their own wearable or timepiece for customization do so at their own risk. Wear Hour Time LLC is not liable for any loss, theft, damage, or defects that occur before, during, or after the customization process.

  • By submitting an item, the customer acknowledges that modifications may permanently alter the item and accepts all associated risks.

• No Liability for Damage or Functionality Issues

  • Wear Hour Time takes reasonable precautions during customization but is not responsible for:

    • Unintended alterations to the material or appearance of the item.

    • Malfunctions or defects that arise as a result of the customization process.

    • Diminished resale value of the item after modifications.

  • Once customization has begun, the process is irreversible, and the original item cannot be restored to its previous condition.

• Insurance & Shipping Responsibility

  • Customers are responsible for properly packaging and insuring their wearable or timepiece before shipping it to Wear Hour Time for customization.

  • Wear Hour Time is not responsible for:

    • Items lost, stolen, or damaged in transit.

    • Delayed or misdirected shipments.

    • Any customs duties or import fees (for international customers).

  • Customers must ensure that their chosen shipping carrier provides tracking, insurance, and proof of delivery.

• Ownership & Legal Rights

  • By submitting an item for customization, the customer certifies that they are the legal owner of the item and have full rights to modify it.

  • Wear Hour Time will not be responsible for ownership disputes or unauthorized modifications requested by a third party.

• Effect on Manufacturer Warranty

  • Customers acknowledge that any customization may void the original manufacturer’s warranty.

  • Wear Hour Time does not guarantee continued warranty coverage from any third-party brand or manufacturer after modifications.

• Limitation of Liability

  • To the fullest extent permitted by law, Wear Hour Time LLC disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from:

    • The loss or damage of a customer’s wearable or timepiece.

    • The results of the customization process.

    • Any defects, malfunctions, or issues that arise post-customization.

  • If a customer’s item is lost or damaged while in Wear Hour Time’s possession, our liability is limited to the cost of customization services paid by the customer and not the value of the item itself.

• Indemnification

  • The customer agrees to indemnify, defend, and hold harmless Wear Hour Time LLC, its employees, and affiliates from any claims, damages, or legal actions related to the submitted item, its ownership, or post-customization performance.

• Dispute Resolution

  • Any disputes regarding customer-provided items shall be resolved through binding arbitration in the state of Texas, following the rules of the American Arbitration Association (AAA).
